By using InstaMessage, you agree to comply with this Policy. If you violate this Policy, we may suspend, restrict, or terminate your account and may take further legal action if required.

This Policy applies to all use of the service and forms part of your Terms of Service.

1. Consent and Customer Messaging

You may only send messages to recipients who have opted in to receive them.

You are responsible for collecting, storing, and managing records of consent.

All marketing or bulk messages must include clear opt-out instructions.

Purchased, rented, or scraped contact lists are strictly prohibited.

2. Prohibited Content

You may not use InstaMessage to transmit, promote, or facilitate content that is:

Spam, junk, or unsolicited bulk messages.

Unlawful, harmful, abusive, harassing, defamatory, discriminatory, or hateful.

Fraudulent, misleading, or deceptive.

Malware, phishing attempts, or malicious code/links.

Related to illegal products or services.

In violation of third-party platform rules (e.g. WhatsApp Business Policy, SMS carrier restrictions).

3. Data Controller Responsibility

You acknowledge that your business is the data controller of any personal data you upload to InstaMessage. You are responsible for ensuring you have a valid legal basis (such as consent or legitimate interest) to collect, store, and use that personal data in compliance with applicable data protection laws. InstaMessage acts only as your data processor in relation to such data.

4. Prohibited Uses

You may not:

Exceed or attempt to bypass messaging limits or quotas.

Use multiple accounts to evade restrictions.

Provision or use numbers or sender IDs without approval.

Resell, sublicense, or otherwise provide InstaMessage to third parties without written consent.

Attempt to probe, scan, or test the vulnerability of any InstaMessage system or network.

Attempt to gain unauthorised access to any accounts, systems, or networks.

Artificially inflate traffic volumes through test traffic, unauthorised routing, or similar mechanisms.

Harvest, scrape, or misuse data accessed through InstaMessage.

5. Restricted Industries

Certain industries may only use InstaMessage with our prior written approval. These include, but are not limited to:

Cryptocurrencies and digital assets.

Gambling, betting, or lotteries.

Payday lending or short-term high-interest loans.

Alcohol, tobacco, and vaping productsAdult content and services.

6. Emergency Communications Limitation

InstaMessage is not designed or licensed for use in contacting emergency services (e.g. 999, 112). You must not rely on InstaMessage for emergency or life-critical communications.

7. Compliance with Laws and Policies

You must comply with:

All applicable laws and regulations, including the UK GDPR, the EU GDPR, and the Privacy and Electronic Communications Regulations (PECR).

 Any other local laws and regulations governing electronic communications and marketing in jurisdictions where you operate.

Carrier and platform rules (e.g. Meta/WhatsApp policies, SMS aggregator rules).

Our Terms of Service, Privacy Policy, and this Policy.

8. Monitoring and Enforcement

We may monitor usage to detect abuse and ensure compliance. This may include:

Reviewing message volumes, content categories, and opt-out/complaint rates.

Blocking or throttling traffic that risks harming recipients, carriers, or our platform, even if technically within your quota.

Suspending or terminating accounts in breach of this Policy.
